Insurance Ombudsman Complaint Process in India

How to escalate insurance grievances through the ombudsman system.

The Insurance Ombudsman is an independent authority in India that resolves disputes between insurance companies and policyholders. If you are dissatisfied with your insurer's response to a complaint, the ombudsman provides a free and expedient grievance resolution mechanism. Before approaching the ombudsman, you must first file a complaint with your insurer's grievance redressal officer and wait for their response, typically 30 days.

If the response is unsatisfactory or no response is received, you can file with the ombudsman. The complaint to the ombudsman must be filed within one year of the insurer's rejection or unsatisfactory response. There are currently 17 Insurance Ombudsman offices across India, each covering specific states and territories.

You file with the ombudsman having jurisdiction over your location. The complaint can be filed online through the IGMS portal or in writing. Eligible complaints include claim disputes where the insurer has partially or fully rejected a claim, premium disputes including alleged overcharging, policy terms disputes involving misrepresentation at the time of sale, and delay in claim settlement beyond the stipulated timeframe.

The ombudsman process involves the ombudsman reviewing both the policyholder's complaint and the insurer's response. A hearing may be scheduled where both parties present their case. The ombudsman can recommend a resolution, which the insurer may accept or reject.

If the ombudsman passes an award, it is binding on the insurer if accepted by the complainant. The maximum award the ombudsman can pass is Rs 30 lakh for general insurance and Rs 30 lakh for life insurance. The ombudsman process is free of charge, and you do not need a lawyer.

If the ombudsman's decision is also unsatisfactory, you can approach consumer courts or civil courts for further resolution.
